Jaybird Jives is operated by Diverse Harvest Homestead LLC, doing business as JaybirdJives. In these terms, “Jaybird Jives,” “I,” “me,” and “my” refer to the business operating this website.
By using this website or placing an order, you agree to these Terms and Conditions, along with the Shipping Policy, Returns and Refund Policy, and Privacy Policy.
Eligibility to Purchase
You must be legally able to enter into a purchase agreement in your location.
Anyone placing an order on behalf of another person, business, or organization confirms that they have permission and authority to do so.
Made-to-Order Products
Jaybird Jives does not maintain ready-to-ship inventory. Most products are created specifically after an order is placed.
Production may begin shortly after checkout. Because of the made-to-order process, changes and cancellations cannot be guaranteed once production begins.
Returns, exchanges, cancellations, replacements, and refunds are governed by the Shipping Policy and Returns and Refund Policy.
Product Information and Mockups
I make reasonable efforts to provide accurate product descriptions, measurements, materials, colors, prices, size charts, and other listing information.
Nearly all product images are digital mockups created in good faith to show what the finished item is expected to look like. These mockups are illustrative and are usually not photographs of the exact physical item a customer will receive.
The finished product may vary slightly from the mockup because of normal differences in:
- Product size and proportions
- Print placement and scale
- Fabric texture and garment shape
- Screen settings and color display
- Lighting and photography
- Production methods
- Dye lots and material batches
Minor variations of this nature are not considered defects. An item that is substantially different from what was ordered may still qualify for review under the Returns and Refund Policy.
Customers are responsible for reviewing the full product listing, selected options, product specifications, size charts, personalization details, and order information before completing checkout.
Use of Artificial Intelligence
Jaybird Jives uses artificial intelligence tools as part of normal business operations.
AI may assist with:
- Mockup creation
- Image editing
- Product descriptions
- Listing information
- Marketing materials
- Website content
- Administrative and creative tasks
AI-assisted content is reviewed and used in good faith, but artificial intelligence can occasionally produce inaccurate, incomplete, or unrealistic details.
If there is a conflict between a mockup or AI-assisted image and the written product specifications, the written product details, selected options, size charts, customization information, and order confirmation take priority.
Customers should review all available information carefully before ordering.
Social Media and Connected Services
Jaybird Jives uses social media platforms and related application programming interfaces (“APIs”) as part of normal business operations, including creating, preparing, managing, and publishing promotional content.
These services may include platforms such as Facebook, Instagram, Pinterest, TikTok, and other providers used by Jaybird Jives from time to time.
When a social media account is connected to an authorized Jaybird Jives business tool, the connection may be used to perform functions specifically supported by that platform and authorized through its account-access process, such as:
- Identifying a connected business or social media account
- Preparing platform-specific marketing content
- Selecting images or other media for publication
- Creating or editing captions, descriptions, titles, hashtags, or similar content
- Selecting supported publishing destinations
- Publishing content when expressly initiated by an authorized user
- Retrieving information necessary to verify connection or publishing status
Jaybird Jives does not request social media passwords through its own website or software. Authentication is handled through the applicable platform’s authorized login or access process.
Access to connected social accounts is used only for legitimate Jaybird Jives business operations and is subject to the applicable platform’s terms, permissions, and technical limitations.

Product Colors, Sizing, and Placement
Actual colors may appear slightly different because of device screens, lighting, photography, fabric, printing methods, and normal production variation.
Measurements and sizing information are approximate. Customers are responsible for reviewing the applicable size chart before ordering.
For apparel, measuring a similar garment already owned and comparing those measurements with the provided size chart is strongly recommended.
I cannot recommend a size or guarantee that a particular size will fit an adult or child of a certain age, height, weight, or body type.
Minor variations in print placement, scale, and color are normal and are not considered defects unless the finished item is substantially incorrect.
Order Acceptance
Submitting an order and payment does not guarantee that the order will be accepted or fulfilled.
Jaybird Jives may cancel and refund an order when reasonably necessary, including because of:
- A pricing or listing error
- Product or material unavailability
- Suspected fraud or unauthorized payment
- An invalid or undeliverable address
- A technical or inventory error
- Content that cannot legally or safely be produced
- Content rejected by a payment, hosting, or production service
- Any other issue that makes fulfillment unlawful or impractical
If Jaybird Jives cancels an order before fulfillment, payment collected for the cancelled portion will be refunded.
Prices, Taxes, and Payment
Prices are shown in the currency displayed during checkout and may change without notice.
The price shown when an order is submitted will generally apply unless there is an obvious pricing, technical, or listing error.
Payment must be completed using one of the payment methods offered during checkout.
Jaybird Jives does not receive or store complete credit or debit card numbers.
Applicable shipping charges and sales taxes are displayed during checkout when required.
International customers are responsible for customs duties, VAT, import taxes, brokerage charges, and other fees assessed by their country. These charges are not collected by Jaybird Jives unless specifically shown during checkout.
Customer-Provided Artwork and Content
Customers may submit photographs, designs, logos, text, names, dates, artwork, or other content for custom products.
By submitting content, the customer represents that they own it or have all permissions, licenses, releases, and legal rights necessary to reproduce and print it.
Jaybird Jives does not independently verify ownership of customer-submitted content.
The customer is solely responsible for claims, losses, expenses, penalties, or legal consequences arising from content submitted without proper authorization.
By submitting content, the customer grants Jaybird Jives and any services involved in fulfilling the order permission to access, reproduce, resize, crop, adjust, transmit, and print that content solely as needed to create and deliver the product.
Customer Proofing and Accuracy
Customers are responsible for reviewing all submitted names, dates, spelling, images, colors, sizes, placement instructions, uploaded files, and other customization details before submitting an order.
Jaybird Jives may print customer-submitted content substantially as provided.
Errors contained in information, artwork, or files supplied by the customer are not considered production defects.
Minor adjustments may be made when necessary for production, including resizing, cropping, positioning, file conversion, and color preparation.
Custom Content Restrictions
Jaybird Jives supports lawful creative expression and will not refuse an order simply because it reflects a customer’s identity, relationship, viewpoint, or protected status.
However, I may refuse or cancel an order containing content that:
- Is unlawful
- Infringes copyrights, trademarks, publicity rights, or other legal rights
- Contains credible threats
- Promotes or instructs illegal activity
- Exploits or sexualizes minors
- Cannot be produced safely
- Violates the requirements of a payment, hosting, or production service
- Could reasonably expose Jaybird Jives or another party to legal liability
Any refusal under this section is based on the submitted content or fulfillment requirements, not the identity of the customer.
Shipping
Production and shipping times vary by product, production location, destination, carrier, order volume, and time of year.
Estimated delivery dates are estimates and are not guaranteed.
Jaybird Jives currently uses simplified flat-rate shipping rather than charging customers the full fulfillment shipping cost for each individual item.
Current shipping rates include:
- United States and Puerto Rico: $5.99 flat-rate shipping; free shipping on orders of $75 or more
- Canada: $7.99 flat-rate shipping; free shipping on orders of $75 or more
- Other supported international destinations: $11.99 flat-rate shipping
Availability may vary by product, size, production location, and destination. Some products may not be available for shipment to every location.
Orders may arrive in more than one package when products are produced or shipped from different locations. Customers will not be charged additional shipping after checkout merely because an order ships in multiple packages.
International orders may also be subject to customs duties, import taxes, VAT, brokerage charges, or other fees imposed by the destination country unless those amounts are specifically shown as collected during checkout.

Cancellations
Orders may only be cancelled before production begins.
Orders often enter production shortly after they are submitted. Once production has started, the order cannot be cancelled, changed, or refunded because the item is already being made specifically for the customer.
Submitting a cancellation request does not guarantee that the order can still be stopped.
Returns, Replacements, and Refunds
Most products are made to order and all sales are final except when an item arrives damaged, defective, misprinted, or different from what was ordered because of an error by Jaybird Jives or the production process.
Returns and size exchanges are not accepted for incorrect size selection, fit preferences, buyer’s remorse, accidental purchases, or changes of mind.
Eligible concerns must be reported within the time stated in the Returns and Refund Policy and may require photographs or other documentation.

Intellectual Property
The Jaybird Jives name, logo, website design, original product designs, photographs, written content, graphics, and other original materials may not be copied, reproduced, distributed, resold, or used commercially without written permission.
Purchasing a physical product does not transfer ownership of intellectual property associated with the design.
Rights in customer-supplied content remain with the customer or the applicable rights holder.
Prohibited Website Use
You may not use this website to:
- Commit fraud
- Submit malicious code
- Attempt unauthorized access
- Interfere with website operation
- Scrape or copy website content for commercial use
- Misrepresent your identity
- Violate another person’s legal rights
- Submit unlawful content
- Place an order for an unlawful purpose
- Abuse payment disputes, chargebacks, refunds, or promotional offers
Third-Party Services
Jaybird Jives relies on third-party services for functions including payment processing, production, shipping, website hosting, email delivery, analytics, artificial intelligence, social media integrations, authentication, and other business operations.
Use of certain third-party features may also be subject to the applicable provider’s own terms, privacy practices, permissions, and service limitations.
Jaybird Jives is not responsible for interruptions, errors, delays, or service limitations caused solely by third-party systems, carriers, service providers, weather, customs, or events outside reasonable control.
I will make reasonable efforts to address legitimate customer-order or service issues affected by those providers.
Website Availability
I do not guarantee that the website will always be uninterrupted, secure, or error-free.
Access may occasionally be limited because of maintenance, updates, outages, security concerns, or circumstances outside my control.
Disclaimer and Limitation of Liability
To the fullest extent permitted by law, Jaybird Jives is not liable for indirect, incidental, special, punitive, or consequential damages arising from use of the website or purchase of a product.
For a claim involving an order, the maximum liability of Jaybird Jives will generally not exceed the amount paid for the product involved in the claim.
Nothing in these terms removes any consumer right or remedy that cannot legally be excluded.
Customer Responsibility and Indemnification
To the extent permitted by law, the customer agrees to be responsible for claims, losses, costs, damages, or expenses arising from:
- Customer-submitted content
- A violation of these Terms and Conditions
- Copyright, trademark, privacy, or publicity-right infringement caused by content the customer supplied
- Fraudulent or unlawful use of the website
- False or misleading information provided during checkout
Resolving Disputes
Please contact Jaybird Jives first regarding any concern and allow a reasonable opportunity to resolve the issue directly.
If a dispute cannot be resolved informally, both parties may mutually agree to participate in mediation with a neutral mediator before pursuing further legal action.
Mediation is not binding unless both parties reach and sign an agreement.
These Terms and Conditions are governed by the laws of the State of Indiana, without regard to conflict-of-law rules.
To the extent legally permitted, any court proceeding must be brought in a state or federal court serving the Indiana county where Diverse Harvest Homestead LLC maintains its principal place of business.
This provision does not remove any consumer right that applicable law requires to be handled in another location.
Changes to These Terms
These Terms and Conditions may be updated periodically.
The version posted when an order is placed will generally govern that order.
Continued use of the website after an update means the revised terms apply to future website use and purchases.
